GENERAL TERMS AND CONDITIONS FOR SHORT-TERM PARKING AND LONG-TERM LESSEES
The following conditions apply to the use of the Bahnhofparking P3 Universität, Lucerne:
1. GENERAL
1.1 The operator of the car park is Tiefgarage Bahnhofplatz AG, Lucerne. In the following text, they are referred to as ‘the operator’.
1.2 The car park is generally open 24 hours a day, 365 days a year.
1.3 The Bahnhofparking P3 Universität, Lucerne is under video surveillance. The surveillance images can be recorded. The images recorded by the video cameras may be made available to the criminal investigation authorities in the event of unlawful acts.
1.4 In the event that the car park is fully occupied by short-term parkers, the long-term lessee is not entitled to a parking space or access to the multi-storey car park.
1.5 The instructions of the operator must be followed in all cases.
1.6 Rental interruptions shall not be granted for holidays or other absences of the lessee. The ticket cannot be saved for this purpose.
1.7 If a company makes a large number of reservations for an event, the long-term tenant is not entitled to a parking space or access to the multi-storey car park.
1.8 No detailed information is provided on the parking operations that have been carried out.
1.9 The one-off processing fee for the parking permit is CHF 20.00 and must be paid in cash when collecting the season ticket.
1.10 The family parking spaces are only intended for families with small children and strollers. In case of disregard, a circulation fee of CHF 50.00 will be charged. We thank you for your consideration.
2. USE OF THE CAR PARK
2.1 Access to and use of the multi-storey car park is exclusively permitted for the purpose of parking motor vehicles (passenger vehicles) with a valid number plate. Motorcycles, bicycles, trucks, trailers, campers and caravans, trendy vehicles and vehicles over 2,10 m in height may not be parked in the car park.
2.2 Motor vehicles must be parked within the marked parking areas. Vehicles parked illegally and vehicles that complicate or endanger the operation of the multi-storey car park or that are parked for more than four weeks or without a number plate shall be reported to the Lucerne police without prior warning. The operator also expressly reserves the right to charge an additional fee for the areas used for vehicles parked outside of the marking lines.
2.3 Washing, repairing, changing oil, refilling petrol, re-setting vehicles with leaking tanks, engines, carburettors, etc., as well as unnecessary running and testing engines is prohibited.
2.4 Users are obliged to maintain peace and order in the car park. Contamination of any kind (e.g. landfilling or leaving waste) must be avoided. Hard braking and rapid acceleration (‘cavalry start’) are prohibited. The costs for removing soiling and tyre marks will be charged to the person responsible or the owner of the vehicle.
2.5 Distributing flyers is prohibited. Distributing flyers or similar advertising material under the windscreen wipers of cars or on the entire site is strictly prohibited. In the event of non-compliance, we will invoice our expenses.
2.6 The traffic rules in accordance with road traffic legislation apply. Violations of the traffic rules will be reported to the police.
2.7 Unauthorised and unnecessary parking in the car park is prohibited. In particular, it is forbidden to stay overnight in a car park.
3. ENTRY AND EXIT/PAYMENT
3.1 Entry is by means of a short-term parking ticket, multi-day pass, long-term pass, conference pass or Lucerne parking pass.
3.2 Exiting is carried out by inserting the parking ticket purchased at the entrance into the exit station – after the due fee has been paid in advance at the pay machine. After inserting the ticket, the ticket machine pulls it in and the barrier opens. The exit barrier can also be opened with a multi-day pass, a long-term parking pass, a congress pass or a Lucerne parking pass, as long as the rules for use have been observed.
3.3 A fee is charged for parking in the operator’s Bahnhofparking P3 Universität, Lucerne. This is based on the applicable tariffs, which are published at pay machines and on the internet. The fee for the other products is based on the corresponding contracts.
3.4 In the event of an improper exit (e.g. following a vehicle when the barrier is open), a processing fee of at least CHF 200.00 shall be payable in addition to the regular parking fee. The operator also reserves the right to file criminal charges. If the operator files a criminal complaint, the processing fee increases in line with the additional effort.
4. LIABILITY
Not all parking spaces are fully monitored. The cars must be locked in the parking spaces. Insurance against theft, fire and other damage is the responsibility of the short-term parking user or the lessee. The multi-storey car park declines any liability.
5. DAMAGE TO EQUIPMENT
5.1 Damage to the operator’s systems and facilities is generally subject to criminal prosecution.
5.2 In the event of a breach of a barrier (damage to the entry or exit barrier), the person responsible must pay CHF 100.00 for expenses on site. If the compensation for expenses is not paid on site, a processing fee of at least CHF 200.00 will be charged. Further claims for damages and criminal charges remain expressly reserved.
6. VIOLATION OF THE CAR PARK REGULATIONS
In the event of a violation of these car park regulations (e.g. failure to pay parking fees), the operator may ban the offending person from entering the operator’s car park or refuse entry to the operator’s car park facilities. The operator shall report any infringements of statutory provisions (e.g. road traffic law, criminal law).
7. LUCERNE PARKING CARD
7.1 Account information can be viewed by the user at any time by logging in online. The user undertakes to pay the parking fees charged on the Lucerne parking card in advance via the internet or in cash. The Lucerne parking card may only be used if the user is not in default of payment.
7.2 The user shall be charged the fees for the use of the paid parking spaces in accordance with the valid rates of the relevant parking operator.
7.3 If the account is overdrawn for a longer period of time, it will be blocked until the accrued parking fees have been paid.
7.4 A fee of CHF 30.00 will be charged for expenses incurred in the event of loss of the Lucerne parking card.
7.5 The validity of the Lucerne parking card is limited to five years from the date of the last charge.
7.6 Im Bahnhofparking P2 (KKL) kann gegen eine Reservationsgebühr von CHF 30.00 einen Parkplatz über das Reservationstool bis um 23:59 Uhr am Vortag reserviert werden. Die Parkgebühren werden zusätzlich zwischen der Einfahrts- und Ausfahrtszeit direkt dem Konto belastet.
8. VIDEO SURVEILLANCE AND NUMBER PLATE RECOGNITION
8.1 On our website and in the car park, a pictogram informs car park customers that the car park is under video surveillance.
8.2 The video images, their recordings and the associated technical equipment are processed by plant employees.
8.3 Recorded video images shall only be copied or stored after an editing order issued by the public prosecutor’s office or a court. The recorded data is protected from unauthorised access by third parties by organisational and technical measures.
8.4 The recorded data is continuously overwritten by new data after a few days. This will permanently delete the overwritten data.
8.5 No personal data is disclosed. unless mandated by an order issued by a legal body.

9. GENERAL PRIVACY POLICY
9.1 By using our website, you agree to the collection, processing and use of data as described below. Our website can generally be visited without registration. Data such as pages accessed or the name of the file accessed and the date and time are stored on the server for statistical purposes, without this data being directly related to you. Personal data, in particular name, address or e-mail address, is collected voluntarily as far as possible. Your data will not be disclosed to third parties without your consent.
9.2 Lucerne shall be the exclusive place of jurisdiction for any disputes arising from this contract. Swiss law shall apply exclusively.
